Floorz Supplies Plus LLC Storage and Pickup Terms and Conditions

Introduction:

Please carefully review these terms and conditions (“Terms” or “Agreement”) governing pick-up orders, encompassing the storage, handling, and pickup of merchandise.

Important Notice:

These Terms significantly affect your legal rights and include a class action waiver, necessitating individual dispute resolution rather than collective or class actions of any kind.

Courtesy Storage:

At Floorz Supplies Plus LLC, we recognize that your new hard surface flooring and decorative fixtures can be exceptionally heavy. We also understand that transporting such heavy materials may require multiple trips to your installation location. To assist you, Floorz Supplies Plus LLC offers up to 7 days of complimentary storage. After the free storage period, a storage fee of $10 per day will apply to any order that remains unpicked. Any applicable storage fees must be paid in full before materials are released.

In-Store Purchases:

For in-store purchases, you must present the original receipt during pickup. Floorz Supplies Plus LLC reserves the right to retain merchandise until proper ownership is established. To authorize someone other than yourself (e.g., a contractor or delivery service) to pick up merchandise, you must grant Floorz Supplies Plus LLC permission to release your merchandise by providing the pickup person’s information. Individuals not listed as authorized pickup persons, irrespective of possessing the original receipt, must receive in-person authorization from you. Authorized pickup persons must present a government-issued photo ID for identity verification, during which Floorz Supplies Plus LLC may collect certain information, such as name and state of ID issuance, to prevent fraud. You acknowledge that these Terms apply to any agent picking up materials on your behalf.

Online Purchases:

For online purchases, you must provide three items for verification during pickup: your online sales receipt, a photo ID, and the credit card used for the online purchase. In cases of second-party pickup, the same three verification items are required, along with the completion of requested information by the person or service conducting the pickup. Authorized pickup persons must also present a government-issued photo ID for identity verification, during which Floorz Supplies Plus LLC may collect certain information to prevent fraud.

Loading and Securing of Merchandise:

Individuals choosing to pick up merchandise from any Floorz Supplies Plus LLC location are responsible for providing a safe and suitable vehicle for transportation, assuming full responsibility for merchandise pickup and transportation. While Floorz Supplies Plus LLC provides assistance with loading purchased merchandise as a courtesy, you are responsible for alerting the employee if you believe the load is too heavy or unsafe for your vehicle. Floorz Supplies Plus LLC retains the right to refuse and/or cease loading services. You are solely responsible for securing merchandise and ensuring it is properly loaded and secured before leaving the premises. Floorz Supplies Plus LLC bears no responsibility for damages to vehicles during loading. If machinery or equipment is in use, you must maintain a safe distance of at least ten feet and exercise caution to avoid injury. You assume full responsibility for loading and/or transporting merchandise, releasing Floorz Supplies Plus LLC from any liability, damages, or claims stemming from your pickup and/or transportation of merchandise.

Safety and Compliance:

Floorz Supplies Plus LLC stores operate as active warehouses. It is vital for all individuals to adhere to safety signs and instructions within the store, including those related to child supervision, restricted areas, and maintaining social distancing during the COVID-19 pandemic. While Floorz Supplies Plus LLC signage and precautions align with guidance from the Centers for Disease Control (CDC) and other authorities, complete protection from COVID-19 cannot be guaranteed.

Product Accuracy Verification:

Ensure thorough inspection of all merchandise at the time of pickup. It is your responsibility to inspect and confirm the type of merchandise purchased, quantity, model number, color, dye lots (for porcelain and ceramic products), and verify all labels on wood products for accuracy before leaving the store. Any discrepancies between your inspection and the sales receipt must be resolved before leaving the premises, and a manager must be informed. Your signature on the receipt at pickup signifies agreement that your order is complete and accurate. No exceptions will be made after you have left the premises.

Communication:

By entering into this Agreement, you agree to be contacted by Floorz Supplies Plus LLC or its service providers via methods such as prerecorded calls, emails, automatic telephone dialing systems, or text messages, using the contact information you provided or is on file with Floorz Supplies Plus LLC. Such communications are for informational purposes only.

“I’m Here” Curbside Pickup and SMS Program Terms:

Upon check-in or texting Floorz Supplies Plus LLC, you will receive messages related to pickup or order status. You can unsubscribe from SMS messages at any time by texting “STOP.” If you encounter issues with the messaging program, you can seek assistance by texting “HELP” or emailing CustomerCareManagement@floorzsupplies.com. Floorz Supplies Plus LLC and carriers are not responsible for delayed or undelivered messages. Message and data rates may apply, depending on your wireless plan.

Informal Dispute Resolution:

In the event of a dispute (“Dispute”), both parties must attempt to negotiate in good faith for resolution by providing written notice to the other party, describing the facts, circumstances, and any relevant documentation. The notice must include your name, contact information, a detailed description of the Dispute, and the relief sought. This informal resolution process should not exceed 90 days. You and Floorz Supplies Plus LLC Parties agree that this informal dispute resolution process is a condition precedent before initiating any formal dispute resolution. Statutes of limitations and filing fee deadlines are tolled during this process.
